SALT LAKE CITY, (ABC 4 Utah) – The state of Utah asked for a stay in the ongoing court battle over same-sex marriage and it was granted within a matter of hours.
In the 120-page written argument the state is asking the 10th Circuit Court of Appeals to uphold Amendment 3 and leave same–sex marriage up to individual states and their democratic processes.
When a federal judge overturned Utah's ban on same-sex marriage thousands of couples rushed to take advantage of the opportunity, while the state vowed to fight it. Governor Herbert talks about why he feels it's his obligation to defend Amendment 3.
