New motions filed for Martin MacNeill

After fighting for a new trial early this week in the Martin MacNeill murder conviction attorneys for MacNeill are back in court on a different case.

SALT LAKE CITY (ABC 4 UTAH) - After fighting for a new trial early this week in the Martin MacNeill murder conviction attorneys for MacNeill are back in court on a different case.  

Motions have been filed on that separate case where he is being accused of sexual abuse. The accusation stems from a court document that says MacNeill put his hand down a female family members pants.

After he allegedly did that, he asked her to sign a piece of paper saying he didn't touch woman.

If 4th District Judge Samuel McVey decides he doesn't want to throw out the case of sexual assault MacNeill's lawyers have asked that the case be moved out of Utah County because of the attention the murder case received.

His lawyer’s also requested that the Utah county prosecutor’s office be disqualified from the case because of their professional conduct.

All this comes before MacNeill sentencing.  He was scheduled to be sentenced on Thursday for the murder of his wife Michele MacNeill but now that has been delayed.
