Juan Manuel Duran was arrested Friday, July 12th and charged with attempted child abuse homicide, domestic assault and domestic violence in the presence of a child.
Patrick Spikes was there Friday when Duran’s girlfriend ran from his apartment.
Spikes said, "She told me he was in there throwing a fit and breaking things."
Spikes told ABC 4 Utah he knows Duran has a temper, but never thought he would hurt the six month old baby.
"I’ve never seen him get violent, but he's verbal,” said Spikes.
Police say Friday night Duran and his girlfriend were fighting for hours and at one point the baby started to cry.
Unified Police Department Lt. Justin Hoyal explained, "Mr. Duran told his girlfriend that he would go check on, and take care of, the child and so he when he went upstairs to check on the child the baby instantly stopped crying."
Hoyal says that's when the girlfriend went upstairs.
"She saw him he had a blanket over the baby's face and mouth and there was a muffled cry coming from the baby,” said Hoyal.
Luckily she was able to get her and her baby out safe.
Spikes said, "I saw her put the baby in the truck before she called 911."
When doctors checked the baby out, he showed signs of being smothered and signs he'd been abused before.
"Once the child got to the hospital they found the child had multiple injuries on multiple parts of his body all in different stages of healing,” said Hoyal.
Hoyal says those old wounds could mean new charges for Duran.
