West Valley City denies appeal to release records related to Susan Cox Powell

WEST VALLEY CITY, Utah (ABC 4 News) –West Valley City Council Members denied an appeal Tuesday to release records pertaining to the disappearance of Susan Cox Powell requested by Cox family attorney Anne Bremner.
WEST VALLEY CITY, Utah (ABC 4 News) –West Valley City Council Members denied an appeal Tuesday to release records pertaining to the disappearance of Susan Cox Powell requested by Cox family attorney Anne Bremner.

Bremner has unsuccessfully tried to obtain the documents three times.

“I’m disappointed, but it’s not unexpected” Bremner said.

Bremner traveled to West Valley City last week to argue her case in front of council members and the city manager where she was denied access to the files. Bremner says she expected council members to uphold the city manager’s decision today.

Bremner anticipates filing a lawsuit against the city to obtain the records.

The West Valley City Police Department has always maintained the case is an ongoing investigation.

Bremner has promised to keep the information confidential if the council had agreed to release the documents.

“I don’t know what could be jeopardized in their investigation by the conditional release to us,” she said.

According to Mayor Pro Tem Corey Rushton, council members deliberated over the decision to release the records within the past week. They also reviewed numerous Utah state laws and poured over the dozens of pages of documents related to the investigation.

“We were asked to review the documents in question,” Rushton said. “After reviewing them, it became very apparent to us releasing them at this time could reasonably be expected to hamper an ongoing investigation.”

Josh Powell, killed himself and their two sons, Charlie and Braden, in February 2012. Powell set attacked the boys and set fire to his Washington state home.

Susan Cox Powell went missing in December 2009. She has never been found.

“Chuck and Judy want to find Susan and they want to have something good come out of a horrific situation,” Bremner added.
